Call to Order: Chairman Bruce Klink, called the public hearing to order at 7 p.m. Bruce Klink stated that the applicant withdrew the following application. Steve McKenna Site Plan Review/Special Use Permit: The applicant is applying for a Site Plan Review/Special Use Permit for Cabins By the Lake to open a Deli. The property is located on Beggs Point Street in the Town and County of Essex. Tax Map #40-73-3-11-000 & 40-73-3-10-000. The following public hearing was opened for: Charles Proutt Site Plan Review: The applicant is applying for a Site Plan Review for the addition of 2 porches; remodel the west façade with new windows and doors; and replace a gazebo with a garden shed. The property is located on Burt Way in the Town and County of Essex. Eileen Shilling owner of the project was present. The EPB acknowledged the written comment from Anne Brewster recommending that the boat shed be turned into the garden shed rather than replace the gazebo. John Doyle asked about the setback to which the EPB said there was no problem. Sally Johnson stated that the applicant would be a great addition to the community. Hearing no further comments, the Proutt public hearing was closed and the Wight public hearing open. Public Hearing for: Richard W ight Site Plan Review: The applicant is applying for a Site Plan Review to tear down and replace the west wing of his camp located on Lakeshore Road in the Town and County of Essex. Tax Map #49.11-1-51.000. Lot size 2.6 acres. Hearing no comments, a motion was made by Don Hollingsworth and seconded by Nick Muller that the public hearing be closed and the regular meeting opened. The motion carried with board members voting as follows: Acceptance of the Minutes: A motion was made by Harold MacDougal and seconded by Nick Muller to accept the November 16, 2006 minutes with clarification. The motion carried with board members voting as follows: Report of the Zoning Officer: Harold MacDougal commented that Margaret MacDougal was in the shoreline overlay and needs a permit. He also mentioned that the Proutt demolition permit was issued by the Zoning Officer before the project was approved by the EPB. Chairman’s Report: Bruce Klink announced that his term expires the end of December and the Town Board would appointment another Chairman. Bruce thanked everyone and stated that he enjoyed his Chairmanship. Suzanne Perley will also be stepping down as she and her husband John would be moving to New Hampshire. Tax Map #49.11-1-51.000. Lot size 2.6 acres. A motion was made by Don Hollingsworth and seconded by Nick Muller to approve the draft permit. The motion carried with board members voting as follows: Steve McKenna request for reinstatement of his previous permit for an addition to the porch for Cabins on the Lake was tabled due to non-representation. New Business: John Doyle Special Use Permit: The applicant is applying for a Special Use Permit to change the use of the second floor of the Emporium building from a retail store and art gallery to a seasonal apartment. The property is located on Main Street in the Town and County of Essex. Tax Map #40.65-3-5.200. An incinolet will be installed as the toilet, only gray water will enter the already existing septic system. There will be no changes to the exterior and parking is not an issue. A motion was made by Don Hollingsworth and seconded by Nick Muller to declare the application complete pending a more complete list of property owners within 500’ of the project. The motion carried with board members voting as follows: The Short Form of SEQR was done. A motion was made by Harold MacDougal and seconded by Don Hollingsworth to declare a negative declaration. The motion carried with board members voting as follows: A motion was made by Nick Muller and seconded by Harold MacDougal to hold the public hearing at the EPB Meeting on January 18, 2007 at 7 p.m. The motion carried with board members voting as follows: Public Comments: Amanda Perez commented on the application process regarding Steve McKenna Site Plan Review/Special Use Permit that was withdrawn by the applicant. She stated that things were seriously missing. There was an issue with the APA and updated drawing should be presented. She wanted to know why it was accepted without all the necessary paperwork. The EPB commented that parking was not an issue and that they did not do the SEQR review because they wanted comments and input from the community. There was no change to the building or setbacks. They have a more complete file with all elements considered. Harold MacDougal asked who had distributed and printed the flyer that made it sound like the EPB was seeking input instead of accepting input from the community. Amanda Perez said she had prepared it and she was within her right to do so. The EPB suggested next time it be signed by the person preparing the notice. Suzanne Perley stated that Steve McKenna has leased the Old Dock House from the Halpins for five years. She stated that all the permits are in place for that business and no further permits are necessary from the EPB. Adjournment: Hearing no further comments, the meeting was adjourned at 8:00 p.m.
