Meeting was called to order at 7:05 PM.  Supervisor Jackson led us in the Pledge to the Flag.

Supervisor Jackson asked for a moment of silence for Jim Doyle, Bill Heavy Sr., Phil Signor
and Howie Atkinson.

On roll call members present were: Councilwoman LaPine, Councilman LaForest, Supervisor
Jackson, Councilman Wrisley and Councilman Sayward.    Also present were Lois Sayward, Jim Morgan, Highway Superintendent and Audrey Hoskins, Town Clerk.

Visitors included Janice Moran, Jane Perry, Maureen Ecclesine, Jonathan Pribble, Jamie Phillips,
Nancy Perrott, Lauren Murphy and Ronnie Hollingsworth.

Supervisor Jackson greeted the visitors and offered the courtesy of the floor.

Stan Tuller, Dock master presented before and after pictures of the Dockmater’s building. 
Stan thanked the Highway Department for all their help.  He also thanked Don Bechta for his
help.  Stan informed the Board that he replaced the boardwalk in the tunnel.  Stan discussed the need for new playground equipment.  The old equipment has been repaired numerous times and it is time to look at new equipment.  Stan informed the Board that a trash can and a picnic table is needed at the Beach House.  There is a need for a porta potty.  Discussed having the same kind of toilet for the Beach house as is at the dump. Supervisor Jackson figured the project could be done for about $1000.  Supervisor Jackson also stated we could get a picnic table from Essex Industries for about $200.   Stan asked the Board to consider becoming  part of the Lake Champlain Paddler’s Club.   He also stated they have several campgrounds south of us.  He feels the location at the Beach would be ideal for a campground. There would be no open fires. Stan stated these campgrounds are monitored by NYS.  Stan requested Jim Morgan’s help in putting up a new flag at Begg’s Point.  Stan stated the dock at Begg’s Point is in good condition.  It needs a good cleaning to get rid of green slime. Stan also suggests using the Beach house as an information center stating there is plenty of room.  Supervisor Jackson directed Jim Morgan, Highway Superintendent to call for a porta potty.   Councilwoman LaPine asked how bad was the playground equipment.   Supervisor Jackson said he was down there and it was ok.

Maureen Ecclesine read the letter from Beautification Committee requesting a space on the
Town Hall lawn to plant an evergreen tree. This is to provide a tree to be decorated for the Town wide Christmas celebration in December.  Supervisor Jackson stated the plans for the back lawn would have to be looked at to see where a tree could be planted.

Motion made to approve May 10th minutes with spelling correction by Councilman LaForest.  Seconded by Councilwoman LaPine.    Roll call:  Councilwoman LaPine-yes, Councilman LaForest-yes, Supervisor Jackson-yes, Councilman Wrisley-yes and Councilman Sayward-yes.

Planning Board Report:  No formal report received. Councilwoman LaPine attended the meeting and stated the subdivision for the Bob Rowe property was discussed.

Supervisor’s County Report:

An appraisal for the Marvin site needs to be done.  Supervisor Jackson does not feel this a nursing home site.  Would be good site for more County parking. 

Public safety building now in use. The jail has a few more details to be finished.  Sheriff Hommes hope to move prisoners in before the end of the month.

The old jail is not a usable building.  Prices are being requested for cost of demolition.

The Confidential Secretary issues at the county were explained by Supervisor Jackson.
John O’Neil wanted to hire a confidential secretary which takes a while to received state approval.  Mr. Palmer, Personnel Officer suggested he hire an Administrative assistant.   Cindy Estus, Director of Social Services, hired the number one person off list as her Administrative Assistant.  The next three candidates were unacceptable.   Then they went back to the Confidential Secretary position.   Councilwoman LaPine was concerned with the way this was done.  Supervisor Jackson assured her it was completely legal.

Correspondence
Senator Clinton announces five million dollar grant for Hamlet wastewater project. Both the House and Senate have passed it.  Senator McHugh office will keep Supervisor Jackson updated as to the progress of the grant.   Councilwoman LaPine asked for a breakdown of the monies.  Supervisor Jackson gave the following breakdown.
1 million  Pataki, 500,000 bond act money,  100,000 loan,  450,000 rural development  grant which we are still applying for and a 1 million dollar loan from Environmental Facilities.  Councilwoman LaPine asked how much is the Town of Essex responsible for.   Supervisor Jackson stated Essex would be responsible for 1.1 million which we will have to borrow.  This money must be used for the sewer project. All the rest of the money is given to us with no strings attached according to Supervisor Jackson.  .

Councilman Sayward asked Supervisor Jackson to give a short serinaro of what is to be expect in the next 6 to 9 months.   We have done the income surveys, the preliminary layout and the radio survey of the ledge. The plants designs are being worked on and then we will be going over them and making decions on that.  Supervisor Jackson hopes by summer end we will be able to start having Public Hearings on this.

Councilman Sayward asked where we are with land acquisitions.  Bob Rowe has done appraisals, but has not gotten back to Supervisor Jackson.  Supervisor Jackson will
call Mr. Rowe. 

Supervisor Jackson hopes to be ready to start project this winter.  The design will not hold up the project. We need to finish rural development grant.  Once we have the design, we have to have the purpose.  We have to have Corps of Engineers for the discharge.  DEC, APA and Planning Board approval.

Councilman Sayward wanted to know who the lead agency was for getting permits.  Supervisor Jackson stated that the Town and AES Northeast would work on the permits together.

Councilwoman LaPine questioned as to where the money for AES Northeast will come from.  Supervisor Jackson stated the money will come from the Pataki Grant.  Councilwoman LaPine asked if we are paying them now and when the Grant money is received, will we reimburse the Town.  Supervisor Jackson said that is correct.
Supervisor Jackson stated the he hoped to receive the contracts for the million dollars Pataki Grant in early July and that they could be signed at our next Board Meeting.

Applicatiants for Planning Board Secretary and the Mowing position were interviewed prior the Board Meeting at 6:30 PM today.

Disinfectants by product are much improved since we solved the filter problems.

Unfinished Business

Councilman LaForest requested we wait on  mowing position and Planning Board secretary as he had to leave for a few minutes.

Local Law for Building Codes will need a Public Hearing.  Councilwoman LaPine
asked if most of the law isn’t in the Zoning codes already.  Supervisor Jackson states that
some of it is.  This is an update for the Uniform Fire Prevention Building Codes. This updates our law to coincide with the new Building Codes.  This is the law our Code Officer has to follow as well as the State Building Codes.  Councilman Sayward asked if Dave Lansing, Code Officer have a problem with the new laws.  Supervisor Jackson stated that Dave thinks the laws are very good.   Councilman Sayward feels we should
set a date for a Public Hearing on the updated Building Code laws.

Employee Manual Review needs to be done before the end of the year.  We need to get
Employee Manual and the Union contract closer in line with each other.  Supervisor
Jackson feels a separate Board meeting should be scheduled to go over the manual and contract. 

Our insurance company does not have a problem with two payments for the new truck.
Councilman Sayward asked the status of the wrecked truck.  Supervisor Jackson stated that someone is interested in buying the engine and may want entire truck.

AES Northeast wanted to have a pilot program for the pump house filter.  Supervisor
Jackson decline because of cost to Town. The study would be about $15,000.  When we
receive Grant money we will consider the study.  AES Northeast understands all we want is the paper work for Grant.

Supervisor Jackson met Sandy Vance and she stated that there is no problem with paying for the water line extension to their new house if we do not receive grant.  Susan Kennedy sees no problem going ahead with extension as DOH does not want people using polluted well water.  She stated if extension done would it not cause us to lose the forty points as long as they are classified as out of district.

Dave Lansing inspected the Library chimney.  He feels the lower part in the basement is fine. The stove pipe is fine. The big problem he sees is the part above the roof.  It will have to be rebuilt and he recommends that while this is be done to have a camera lowered
down and inspect it.  Then a decision can be made as to whether or not it will need to be relined.  Janice Moran voiced her concerns about the condition of the pipe in the basement.  Supervisor Jackson stated Dave Lansing inspected it and felt is was fine.
Jonathan Pribble offered the use of his camera to Town to inspect chimney. 

Motion to hire someone to repair Library chimney made by Councilman Sayward.
Supervisor Jackson asked Lauren Murphy who she used for a mason.  She said John King. Supervisor Jackson also named John Podmore.  Supervisor will call both men and
see if they can give us an estimate.  Councilman Sayward stated we need to be very specific as to what we want done.  Supervisor Jackson felt that the bricks could be reused.

Supervisor Jackson requested permission to sign contract amendment with the Teamsters.  Motion made to authorize Supervisor Jackson to sign contract amendment with the Teamsters by Councilman LaForest. Councilman LaForest asked for clarification of insurance benefits because he understood if a person works twenty years continuous service and then left the Town he would not be eligible to receive health insurance benefits paid for by the Town until he was eligible to receive retirement from NYS Retirement system.  Supervisor Jackson stated this is true.

Supervisor Jackson also stated that a layoff of less than a year does not constitute a break
in service.  You would have to work 20 yrs. Plus time laid off.

Thanks to Councilwoman LaPine’s phone calls we now know what we need to do
for water district extension.  Supervisor Jackson has to write a legal notice for the
Valley News.  There is no change in the two water districts; it just makes the DOH happy
that they are coded in.  We have had the maps done.  We will have to have another
Public Hearing with the actual map and the plans.  Then we can file it with the Town
Clerk, the Comptroller and the Secretary of State.   Supervisor Jackson hoped to combine
this hearing with the one on local law.    

Councilwoman LaPine spoke with Gilbert Belize about finishing Town water meters.
Need keys for Olsen house and Jan Eakins will contact him and see who is the local person with a key.

Councilman Sayward asked if we had any luck in getting someone from the County to write a program for the water bills.  Supervisor Jackson stated Mike Brenish said he would like to, but he has not had the time to work on the program.  Councilman Sayward asked what is plan B.   Supervisor Jackson stated that the billing programs that are out there are mainly for larger areas.  He said we would do research and see if we could find a program suitable for our use. 

 

New Business

A copy of the Outdoor Furnace law was received from Gerald Morrow, Supervisor of Town of Chesterfield.   Supervisor Jackson feels the law is very good. Mainly concerned with the Hamlet area and the closeness of your neighbor.  Janice Moran asked how close is close.  Supervisor Jackson said their law state 200 to 500 feet. Councilman LaForest
asked Janice if she has had any problems with outdoor furnaces.  She stated when walking if wind is blowing from the north yes, but it is not a lot.  Ronnie Hollingsworth wanted to know what the difference is between an outdoor furnace and a wood stove in your house. The height of the chimney stated Supervisor Jackson. Outdoor wood furnaces that are well designed tend to be more expensive and a lot of people buy the least expensive model.  People tend to burn green wood in them and green wood smokes more than dry wood. Councilwoman LaPine asked if people use these furnaces year round.  Councilman Sayward pointed out that under the Chesterfield law outside furnaces are not allowed to be used in summertime.  Supervisor Jackson asked the Board member, to read the law and next month there would be further discussion.   Supervisor Jackson also stated that the law would have to be published and the Public Hearings would have to be held. 

Town Hall Christmas Tree:  Supervisor Jackson asked Board if they wanted to table this until he could find the plans for backyard of Town Hall.  Councilwoman LaPine asked if
it is not possible here, how about the parking lot. Supervisor Jackson said we would have ask ECHO.  Motion to approve Town Christmas Tree subject to a suitable location being
found for planting made by Councilman Sayward.  Seconded by Councilman Wrisley.

Insurance policy renewal time coming quickly.  Supervisor Jackson feels that this is not a
good year to look for a new agency, since we just totaled a truck. Supervisor Jackson
told the Board if they want to look for a new agency now is the time we need to start looking.  Supervisor Jackson feels that we would be wiser to wait and have a cleaner record before we look for a new insurance agency.   The Upstate Agency is willing to renew us but they haven’t given a rate.  

Judge Dawson has ruled in favor of the Eddy Foundation tax exempt status. Only the Black Kettle original parcel is covered by the ruling.

Last month we discussed hiring someone halftime or fulltime to do the mowing, other odd jobs and be a wing man in the winter. Jim Morgan, Highway Superintendent, has suggested the Town create a DPW and this work could be taken of by them.  Councilman Sayward voiced concerns about the union and if an operator could be assigned labor’s
duties.  Jim stated that in the contract he can assign them to do this work.  They would be paid at an operator’s rate.    Paul Engel says we would need to add one paragraph
to change over.  He has done this for a number of Towns.  He also said you need to have the men in agreement for this change.  The only problem would be weekend water and sewer duty.  Supervisor Jackson told them that he would have no problem exempting them from these duties. If we want to go forward with DPW, like any local law we need to come up with the wording and then have a Public Hearing.  Supervisor Jackson believes this would have to be put on the ballot.   Councilman Sayward feels that we should proceed with plans for a DPW.   Councilwoman LaPine asked if a DPW was going to be created for four employees.  Supervisor Jackson stated that they would hire another person who would be hired into the DPW instead being hired to mow lawns.  Councilwoman LaPine asked what the advantage of a DPW is.    Supervisor Jackson stated you can have the people do different jobs.  Jim can’t tell them now to mow the ball field or go down and help Emmett Coonrod with the pump house, as a DPW he will be able to assign these kind of jobs.   DPW allows for billing the different account for the work the men do.  If they work at Transfer Station he would bill this time to the Transfer Station. CouncilwomanLaPine concerned about who would do all the paper work.  Supervisor Jackson stated that Jim Morgan, Highway Superintendent, would be doing the paper work.   Lois Sayward stated that everything would have to be broken down by fund.  Supervisor Jackson stated Jim does this now. He keeps tract of what they do everyday, so he would just have to assign the hours to the correct fund Gerneral, Highway, etc.  Councilwoman LaPine stated she could see it if we were including Water and Sewer in it, but not now.  Councilman Sayward feels we need to start now so a year or two down the road we are not still sitting here with just a Highway Dept.  We need to get started so that this can be on the ballot.  Councilman LaForest also feels we need to start the process. Do the Public Hearings. It may not even get off the ground.  Councilman Sayward stated if it goes to ballot it might be voted down.  Supervisor Jackson asked Jim Morgan to talk with the crew again and make sure they are in agreement.  Supervisor Jackson will talk with Paul Engel about the official wording for the contract.   Lois Sayward concerned about the amount of additional bookkeeping that will need to done each pay period.   Councilman Sayward and Wrisley felt we would have a better handle on expenditures.

Next we have a happy time.  One of our citizens just became an Eagle Scout last
Friday night, Kevin Sayre. Kevin’s project was repairing the headstones in Brookfield Cemetery.  Not every stone was repairable, but a sizable number were repaired.  It shows how some kids are undisciplined and can cause problems where others are disciplined
and are community spirited and can solve problems.   Supervisor Jackson felt this was
a great project and was very happy that Kevin completed it and became an
Eagle Scout.

RESOLUTION #9 of 2007
June 14, 2007

THE FOLLOWING RESOLUTION WAS OFFERED BY SUPERVISOR JACKSON, WHO MOVED ITS ADOPTION.

WHEREAS, The Town of Essex believes it is proper to pause now and then to applaud the accomplishments of one of its residents; and

WHEREAS, Kevin Sayre becoming an Eagle Scout on June 8, 2007 certainly rises to the level of deserving this applause, and

WHEREAS, Kevin Sayre’s Eagle Scout project was repairing the damaged grave markers in the Town of Essex Brookfield Cemetery, and

WHEREAS, the fact that this damage was caused by youths who lacked the discipline gained from being a Boy Scout and the sense of duty to your Community that comes from being a Boy Scout, therefore  

BE IT RESOLVED that the Town of Essex Congratulates Kevin Sayre on achieving the high honor of becoming an Eagle Scout and wishes him continued good luck and high levels of achievement in the future.

Resolution # 10 Permission for Supervisor Jackson to sign agreement with DOT for $175,000 and the $15,000 legislative grant for the Lake Street Wall.  Councilwoman asked if this would pay off the Lake St. Wall.   It will be close mainly because of all the work Jim Morgan did stated Supervisor Jackson.  There will be very little Town money spent. Councilwoman LaPine also inquired about the facing.  Supervisor Jackson stated that Councilman LaForest is working on a grant for this. Councilwoman LaPine asked if both sides will be done.  Supervisor Jackson stated yes.  

 

RESOLUTION # 10 of 2007
June 14, 2007

THE FOLLOWING RESOLUTION WAS OFFERED BY COUNCILMAN LAFOREST WHO MOVED ITS ADOPTION.

WHEREAS, The Town of Essex has been fortunate to receive two Legislative Initiative Grants to help with the reconstruction of the Lake Street Wall through NYSDOT due to the efforts of Senator Betty Little and Assemblywoman Teresa Sayward; and 

WHEREAS, the March 17, 2006 Grant for $175,000 and the May 3, 2007 grant for $15,000 require a Resolution authorizing the Supervisor to execute these agreements with NYSDOT and to sign all related documents; so

BE IT RESOLVED that the Town of Essex Authorizes the Supervisor to execute these agreements with NYSDOT and sign all related documents. 

THIS RESOLUTION WAS DULY SECONDED BY COUNCILMAN SAYWARD AND WAS ADOPTED.

Councilman Sayward asked if Fuller was going to finish  up.  Supervisor Jackson stated next week they hope to come down mid-week to finish up what they need to do.  They will bring someone with a transit and help Jim Morgan with what has to be done.  We will be paving the week after.  

Legion Hall:  Supervisor Jackson asked Councilman Sayward if Todd Goff had contacted him. He has the paper work that is needed.  Lou Comeau sent the three documents that need to be done.  It is just a matter of time until Todd Goff calls the people together to
to revise the purchase agreement so it precedes the reverter clause.  Councilwoman
LaPine asked if the State or National American Legion needed to be contacted.  Supervisor Jackson stated no. Councilman LaForest stated they had not been paying due to the National Legion so they cease to exist.  Lou Comeau felt that all we needed were the three documents he prepared   He had checked with Joe Provoncha who told him he needed the three documents.   Motion to give permission to Supervisor Jackson to sign revised Legion Purchase agreement made by Councilman LaForest.  Seconded by CouncilwomanLaPine.  Roll call:  Councilwoman LaPine-yes, Councilman LaForest-yes, Supervisor Jackson-yes, Councilman Wrisley-yes and Councilman Sayward-yes. 

Supervisor Jackson informed the Board that he had not talked with ECHO in the last month. The last time he talked with David Hislop he had not checked on what they had to do as far as receiving their grant money for the Legion Hall. Once that is straightened out, we can go ahead with Janet Knoll and start the final design and the bid documentation.  This is the only thing we are lacking on our side.  They have some work left on their side. Supervisor Jackson hopes to get this done this fall.

The BRASS contract will not be discussed tonight.

TheBoquet Theatre Festival rental agreement which Dr. LaForest has written up for use of the Grange Hall was discussed.  Councilwoman LaPine wanted to know how much it cost to clean up after them last year.  Councilwoman LaPine stated she knew it was a lot of volunteers doing the clean up, but weren’t they the ones that left the mess.  Supervisor
Jackson said yes and that is why there is a deposit of $150.00 this year.  Councilman LaForest stated this deposit will cover clean up.  He also had a talk with them about
the condition the Grange was to be left in.  Councilman LaForest has a provisal about
their use of electricity. They will have to pay the difference between our normal use and
the extra they use.  Supervisor Jackson informed the Board that Bill Mock went out and checked the Grange Hall and the meter was spinning and he turned the stove breakers off and the meter then turned very slowly.   If the Grange Hall is going to be used for any dinners we need to have an electrician check the stove.   

Councilman Sayward stated he felt that in future contracts for the Grange Hall use needed
 to be spelled out as to who will determine the damages. Councilman Wrisley stated he felt the custodian for the building should be the one to determine if Grange has sustained any damages and if it has been properly cleaned.  Motion made to sign rental agreement as amended made by Councilman Sayward.  Seconded by Councilman Wrisley.  Roll call: Councilwoman LaPine-yes, Councilman LaForest-yes, Supervisor Jackson-yes,
Councilman Wrisley-yes and Councilman Sayward-yes.

Supervisor Jackson informed the Board that we received credits on our electric bills. A
discussion ensued over how we are billed for our electric service.

Motion made to sign Smith House contract made by Councilman Sayward.  Seconded by
Councilwoman LaPine.  Roll call:  Councilwoman LaPine-yes, Councilman LaForest-yes, Supervisor Jackson-yes, Councilman Wrisley-yes and Councilman Sayward-yes.

Supervisor Jackson stated that to open a checking account we now need Board approval.
Motion made to open a checking account for the Cultural Grant at CNB by Councilman Wrisley.  Seconded by Councilwoman LaPine.  Roll call:  Councilwoman LaPine-yes,
Councilman LaForest-yes, Supervisor Jackson-yes, Councilman Wrisley-yes and
Councilman Sayward-yes.

Supervisor Jackson asked Lauren Murphy if she knew if David Hislop had made any
progress on the Old Stone Church project.  Of the questions he was to get answered, the most important was when do they expect to get approval so that we can get the money. Lauren did not have an answer for Supervisor Jackson, but told him David would be back in Town on Friday. 

Lois Sayward asked for permission to start looking for software for bookkeeping.  Councilwoman LaPine asked if the Auditors would recommend a software package.  Lois stated they would only tell what was not a good package.  They cost about $15,000 to $20,000 plus yearly maintance.  Supervisor Jackson said he would checkout at the County to see what the different Towns use.

Councilwoman LaPine asked if September 2006 books had been check yet. Town Clerk
said no.  Mike Deskin promised he would do it.  Supervisor Jackson said he would speak
to Mike again.  Councilwoman asked about a State Auditor.  Supervisor Jackson stated that it would take awhile to get them to come.   Councilwoman LaPine called Mike Deskin and he told her they do not do audits.

Councilman Sayward asked if we are still buying waste from NYCO Minerals and using it on our roads.  Supervisor Jackson stated yes, except roads bordering Sandy Lewis’ land.
Supervisor Jackson stated the amount paid to NYCO is being reimbursed to us by FEMA.
We will probably receive $2,000 to $3,000 from FEMA due to the last declared disaster. Motion made to accept bills as presented made by Councilman Sayward.  Seconded by Councilman Wrisley.   Roll call:  Councilwoman LaPine-yes, Councilman LaForest-absent, Supervisor Jackson-yes, Councilman Wirsley-yes and Councilman Sayward-yes.

Supervisor Jackson stated he wanted to set a date for Public Hearing for Employee
Manual review.  The Board discussed possible dates and set June 25, 2007 at 7PM as the
Public Hearing date.    Councilwoman LaPine stated she had read the manual and wanted to know if there was a problem with the manual.  Councilman Wrisley stated there were no problems.  We just have to go over to see if any changes are needed.  He also stated that the last time it was reviewed there were changes made.   Supervisor Jackson stated we have to make some changes because our contract with the Union is changing the insurance.  He also stated that he has no problem grandfathering in the employees already working for the Town. Supervisor Jackson stated the Union contract and the Employees Manual need to coincide.  The Town crew needs to abide by the Employee Manual.  We have talked about changing the Manual so that we could hire Willsboro residents at the
Transfer Site.   Supervisor Jackson stated he has mixed feelings on this issue.

Motion made to appoint Erin Hall as Planning Board secretary made by Councilman
LaForest.  Seconded by Councilman Sayward.  Roll call: Councilwoman LaPine-yes,
Councilman LaForest-yes, Supervisor Jackson-yes, Councilman Wrisley-yes and
Councilman Sayward-yes.

Supervisor Jackson and Councilman LaForest talked with Jim Cannon about the
mowing position since he could not attend the meeting tonight.  Supervisor
Jackson also stated he spoke to Jim about doing some odds jobs around the Town Hall.
He is going to paint the front and back porches.   

Misty is doing a great job mowing but it is costing us more than we paid Eugene Benway
last year.  Councilwoman LaPine asked if Kevin Sayre was going to mow out front when he mows.   Supervisor Jackson stated he did do front the first time he mowed, but this time he didn’t.  Jim Morgan will speak to him about the mowing and trimming again.  Supervisor Jackson stated this one of the problems with having so many mowers.  He also stated something will need to be done about the situation next year.  Councilwoman LaPine asked if we are locked into having all the mowers continue since they had started the jobs already.  Supervisor Jackson stated that the only position being discussed was the one Misty Murcary is doing, which includes the cemetery and the ball field.   Supervisor Jackson stated that next year whether we have a DPW or not there will not be eight mowing positions in town.  Supervisor Jackson asked the Board if they hire Misty do they want to tell her not to mow as often. Councilman Wrisley asked if Jim Morgan, Highway Superintendent supervised her and Supervisor Jackson said indirectly.  Councilwoman LaPine concerned about the cost since we have already paid her over $1000 and we have at least 3 more months of mowing left. Councilwoman LaPine stated that Misty is doing a very good job.  She wondered who uses the ball field.

Supervisor Jackson stated that last year it was used a fair amount.  Councilman Sayward stated that we should set some standards for mowing such, as if it is less than 3 inches it does not need to be mowed.   Supervisor stated he feels that we just need to give her some guide lines.   Supervisor Jackson stated that the Board is concerned about the number of hours.  Supervisor Jackson stated that the first mowing had to raked and mowed again.  Councilwoman LaPine stated that she feel is was too bad that these people just started and Donald Christian was told he would he was going to the Grange. Misty said she was going to mow.  Supervisor Jackson stated this was apples and oranges; it is not the same piece of grass.   Councilwoman LaPine stated she knew that they were not talking about the same piece of grass but the same thing happened with Don Christian as with Misty because Don wasn’t mowing the Grange last year.  Supervisor Jackson stated that we did not own the Grange last year.  Leta MacDougal mowed the Grange last year. Supervisor Jackson stated he did not think that there would be an extra lawn to mow this year.  Councilman LaForest thought Leta was mowing gratis but the Grange was paying her.  Councilman Wrisley stated the Grange was paying her $35.00 to mow and we were only paying $15.00 so she declined to do the mowing.  Councilwoman LaPine stated she did not know why we interviewed since it seemed the decision was already made.  Supervisor Jackson stated it had not been decided and that is why we are discussing the matter.  Misty filled in until a decision was made by the Town Board.

Councilman LaForest stated that this shouldn’t happen next. Supervisor Jackson stated that this would be dealt with in March of next year.  Supervisor Jackson stated that if we hire Misty we need to ask for a little less mowing and a little more time in between.  Councilman LaForest made the motion to hire Misty Murcary to do mowing subject to a decision by Supervisor Jackson and Jim Morgan, Highway Superintendent, as to what is sufficient time for mowing.   No second.   Councilman Sayward made the motion to hire second Benway boy.  Supervisor Jackson felt that he could not be turned loose mowing without direct supervision.  Supervisor Jackson stated we could try him.  He also stated we have two motions and no second for either one of them.    Councilman LaPine stated she has no problem with Misty, just the way it was done. Councilman Wrisley stated he did not know either boy.  Councilman LaForest stated that since we had two names, let’s just take vote and see if we can get a plurality.  Supervisor Jackson stated we could not do this without a second.  Councilman LaForest seconded Councilman Sayward’s  motion. Councilman Wrisley stated he hated to have to someone keep an eye on him and since Supervisor Jackson knew him it carried some weight. 

Councilman Sayward stated it’s like anything else you give the person a chance and if he messes up he is done.  Roll Call: Councilwoman LaPine –abstained, Councilman LaForest-no, Supervisor Jackson-no, Councilman Wrisley-no, and Councilman Sayward-yes.  Motion not passed.   Councilman LaForest reintroduced motion to hire Misty Murcury to do mowing of the cemetery and ball field for the remainder of the 2007 mowing season subject to being called by Supervisor Jackson or Jim Morgan when mowing is needed.   Councilman Wrisley stated that he hoped the hours were high because of the amount of work needed to get the first mowing done.  He felt as season goes on that the number of hours should decrease with the dryer weather.  Councilman Wrisley stated he was going by the Burt cemetery that Jerry Pierce does.  He mows it three times a year depending upon the weather, sometimes he will have to mow it four times.   Councilwoman LaPine asked how much does it cost a year.   Councilman Wrisley stated about $1000.00 to do both old and new cemetery.   Councilman Wrisley seconded.   Roll call: Councilwoman LaPine-abstained, Councilman La Forest-yes, Supervisor Jackson-yes with the conditions mentioned.  Councilman Wrisley-yes and Councilman Sayward-no.  Passed.

Councilman LaForest made the motion to adjourn.  Meeting adjourned at 9:45 PM.
