Call to Order:  Bruce Klink called the public hearing to order at 7 p.m. for: 

John & Trish Walker/Jack Halpin Special Use Permit for Old Dock House.  The applicants have applied for a Special Use Permit for the Old Dock House.  The property will be operated as a continuation of the former permit for the Restaurant & Marina and is located in the Town and County of Essex. Section 40.65 Block 3-4.002.

Hearing no comments, a motion was made by Nick Muller and seconded by Don Hollingsworth to close the public hearing. The motion carried with board members voting as follows:

The public hearing was opened for:

Miriam Lane & David Martin/Robert Burley Special Use Permit: The applicants have applied for a Special Use Permit for a Gourmet Deli Shop and Essex Wine Shop.  (Formerly Main Street Eatery). The property is located in the Town and County of Essex. Section 40.73. Block 6. Parcel 6.100.

The applicant explained in the previous application submitted for the Sangria Café and Wine Store that they would not be able to proceed as originally planned. Two engineering firms and the Department of Health assessed the feasibility of adding an additional rest room to the building.  Since this is an increase in the number of seats over prior usage, the DOH would require full compliance to their standards for the wastewater treatment.  There are insufficient land/soil conditions to upgrade a waste water system that would meet code.

Therefore, the applicant decided that they would proceed with opening a Gourmet Deli Shop with just a few outside tables.  They would like to move up the opening of the wine store to May 2006.  Beer and wine will be on a cash and carry basis only.    

Colleen VanHoven asked about signage.  Ms. Lane said there would be one in the window along with the NYS liquor license number and the other would be a sandwich board sign that meets the sign limit.

Colleen asked that they refrain from having outside music as they do at the Turtle Island Restaurant because Essex is a residential area.

Liz Wilson asked if the parking situation would change and the EPB said no.

Hearing no further comments, a motion was made by Nick Muller and seconded by Don Hollingsworth to close the public hearing. The motion carried with board members voting as follows:

The Regular meeting was opened at 7:15 p.m.

Acceptance of the Minutes:  A motion was made by Harold MacDougal and seconded by Nick Muller to accept the January 19, 2006 minutes with clarification comments. The motion carried with board members voting as follows:

Report of the Zoning Officer:  A letter was sent to the Lake Champlain Ferry Company asking them to remove the neon open sign from the ticket booth. They have complied with the request.  Dave Lansing has certified the safety of the Burley’s deck structure.  See the attached sheet for a more detailed report from the Zoning Officer.

Chairman’s Report:  The law has been passed allowing for alternate Planning Board Members but it needs to be filed with NYS Department of State.  Charles Cammack has requested to be considered for the position.

Old Business

John & Trish Walker/Jack Halpin Special Use Permit for Old Dock House. The applicants have applied for a Special Use Permit for the Old Dock House.  The property will be operated as a continuation of the former permit for Restaurant & Marina and is located in the Town and County of Essex. Section 40.65 Block 3-4.002.

Upon a written request from the Halpins, the following items were addressed and agreed upon:

The date of operation in the original permit was not restricted and asked that it remain the same.

Change the hours of operation to 1 a.m. for Sunday through Thursday and 2 a.m. on Friday and Saturday.

Vegetation screening for the sewage tanks. The Walkers agreed to find a way to minimize the visual impact of the tanks.

The seating capacity will be determined by the Department of Health.

A motion was made by Nick Muller and seconded by Suzanne Perley that the draft permit be approved with the amended changes outlined above. The motion carried with board members voting as follows:

Under summary:
#6 the Gourmet Shop will operate daily from 6 am to 9 pm.
#7 The Wine Shop will operate six days a week from noon to 8 pm and will close on Tuesday.
 
Under Conditions:

#2 This permit shall be subject to approval from the Department of Ag and Markets.

Remove #5 about the restrooms.

A motion was made by Don Hollingsworth and seconded by Nick Muller to approve the draft permit with the amended changes above. The motion carried with board members voting as follows:

Olive Alexander and Alexandra Noble Minor Subdivision/Lot Line Adjustment: A letter was received from the APA declaring the application complete.  The EPB reviewed the revised Survey Map.  A motion was made by Nick Muller and seconded by Harold MacDougal to authorize Bruce Klink to sign the revised survey map subject to APA approval.  The motion carried with board members voting as follows:

Mark and Erin Hall Site Plan Review:  The applicants have applied for a Site Plan Review to extend the south side of the porch, replace the exterior siding, trim, windows and roof.  The property is located in the Town and County of Essex. Tax Map #: 40.73-5-15.000.

A motion was made by Nick Muller and seconded by Harold MacDougal to deem the application complete.  The motion carried with board members voting as follows:
