Call to Order:  Vice Chairwoman Suzanne Perley, called the public hearing to order at 7 p.m for:

John Doyle Special Use Permit:  The applicant is applying for a Special Use Permit to change the use of the second floor of the Emporium building from a retail store and art gallery to a seasonal apartment.  The property is located on Main Street in the Town and County of Essex. Tax Map #40.65-3-5.200. 

Amanda Perez and Jan Eakins had concerns about not being able to identify where the septic system was.

John Doyle explained that an incinolet will be installed as the toilet, only gray water will enter the already existing septic system.

Hearing no further comments, a motion was made by Don Hollingsworth and seconded by Nick Muller that the public hearing be closed and the regular meeting opened.  The motion carried with board members voting as follows:

Regular Meeting:

Roll Call: Present: Nick Muller, Suzanne Perley, Joan Stephan, Harold MacDougal, Don Hollingsworth.  Absent: Mark Walker.

Acceptance of the Minutes:  A motion was made by Harold MacDougal and seconded by Nick Muller to accept the December 21, 2006 minutes. The motion carried with board members voting as follows:

Report of the Zoning Officer:  Suzanne Perley read the report.  The EPB asked the Zoning Officer to not issue demolition permits before the project was approved by the EPB.  The EPB stated if the owner tore down his building and did not get approval from the EPB then the owner would not be very happy.

Dave Lansing said there are some projects that do not need to come before the EPB and that he uses his judgment when issuing the permit.

Chairman’s Report:  Suzanne Perley will be stepping down as she and her husband John will be moving to New Hampshire.

Nick Muller, on behalf of the EPB, thanked Suzanne Perley as the prime mover of the Town Ordinances and moved a resolution of appreciation for the work Suzanne Perley did for the Town Of Essex, Essex Planning Board and the community. She will be greatly missed! The motion carried with board members voting as follows:

Old Business:

John Doyle Special Use Permit:  The applicant is applying for a Special Use Permit to change the use of the second floor of the Emporium building from a retail store and art gallery to a seasonal apartment.  The property is located on Main Street in the Town and County of Essex. Tax Map #40.65-3-5.200. 

Suzanne Perley asked if there was any way we could find out where the septic water was going?  The EPB suggested putting in a holding tank to capture the waste.  John Doyle stated we have been waiting 5 years for a sewage system to be installed by the Town.  In his opinion, a holding tank was an eye sore and that he really did not want to spend a lot of money because it was a seasonal rental and he felt he would never recoup his money.

Don Hollingsworth stated he had no problem with an incinolet toilet and the gray water.  Harold MacDougal said we should find out where the gray water was going because it was our responsibility to look into anything damaging to the Lake.

John Doyle agreed to a dye test to see if the water was a direct line to the Lake.  He will present the results at the next EPB meeting. 

John asked if he did not rent the building did he have to come back to the EPB to reopen it as a commercial business again.  The EPB said that all he need do is ask for an extension because the original permit follows the owner.  They suggested that John document trying to rent the apartment.   

 

Susan Bacot-Davis/George Davis Site Plan Review:  The applicant is applying for a Site Plan Review for the “Rosslyn” or “W.D. Ross House” to renovate the existing west wing resident. The property is located on Essex Road in the Town and County of Essex. Tax Map #040.65-1-3.000.  Lot size 2.859 acres.

The Davis’ gave an overview of the entire project.  They are hoping to accomplish the following:

  • Eradicate chronic water damage (rot and mold) to existing structure
  • Recover architectural integrity of west ell including north, south and west facades
  • Add modern conveniences without impacting use/layout of historic structure.

 

The are three buildings on the property - the ice-house, carriage house and dock house on the lake side.  The asbestos shingles will be removed.  Brick and wood and organic paint will be used.

The septic system is very old and the applicants need to identify where it is and if it is working correctly. A footprint needs to be submitted. 

Nick Muller asked the Davis’ their completion timetable.  They said that they were hoping to get it done by summer.  Nick said the work need to commence within a year with a completion date of 2 years.

The EPB granted permission, prior to issuing the permit, so the Davis’ could take the necessary action to stabilize the foundation with footers drainage to the west and south of the ell.

A motion was made by Don Hollingsworth and seconded by Nick Muller to declare the application complete pending a letter from a certified engineer on the status of the septic and the presentation of the footprint. The motion carried with board members voting as follows:

SEQR was done.  A motion was made by Harold MacDougal and seconded by Don Hollingsworth to declare a negative declaration.  The motion carried with board members voting as follows:

A motion was made by Nick Muller and seconded by Harold MacDougal to hold the public hearing at the EPB Meeting on February 15, 2007 at 7 p.m. The motion carried with board members voting as follows:

Don Hollingsworth, Yes
Mark Walker, Absent

The Davis’ said they could not attend the February meeting.  The EPB stated that they would need to write a letter authorizing someone to represent them.

Public Comments

Amanda Perez asked why the Davis’ had to get a certified engineer for their septic system and John Doyle did not?  The EPB stated that the Davis’ are adding a laundry, bathroom, etc. and John is not.  The EPB said you need to find a balance and not hold people up.  If there is a problem with John Doyle project, then we will look at it at the next meeting. 

Jan Eakins asked about the procedure for notifying neighbors for the public hearings.  She said she had not received a notice. The applicant submits the names and addresses of all those within 500’ of the project. Echo was on the mailing list.
